Changes in the Taxation of Food Supplements

    In May, the Court of Justice of the European Union (CJEU) issued a ruling on case C-252/24. The case involved a liquid food supplement containing iron, which the Court determined should be categorised under “non-alcoholic beverages” instead of “Food preparations not elsewhere specified.”

    The Court clarified that the liquid form of such supplements is an objective characteristic that justifies their exclusion from the “Food preparations not elsewhere specified” category.

    This ruling could lead to the reclassification of certain liquid food supplements as beverages, making them subject to national beverage taxes and different customs procedures.

 

 

Romania: VAT rate change for food supplements

    The Romanian Government announced an increase in the VAT rate on Food Supplements from 9% to 21%, effective August 1, 2025. This decision was made without consulting the industry and is expected to have significant repercussions for the food supplement sector and market.
