Novel Food consultation process for a patented ingredient
A South Korean company contacted us to determine how their patented ingredient would be classified in the European Union. As part of the process, we conducted a Novel Food assessment, and the report we provided included the following:
- An explanation with evidence supporting how the ingredient will be classified in the European Union (as Novel Food or Non-novel Food)
- A list of the requirements and documentation needed when applying for a Novel Food consultation from an EU Member State
- Identification of specific considerations for Europe or particular European markets
- Development of the ingredient’s label
- Suggestions for different names for the ingredient based on its characteristics
- Identification of potential official claims that could be used in the European market
Our client utilized the report to clarify the classification of their patented ingredient for their new European customers.
