South Korea Proposes Standards for Environmental and Efficacy Claims

On 23 February 2026, the Korea Cosmetics Association (KCIA) announced proposed amendments to the Cosmetics Act aimed at strengthening oversight of labelling and advertising claims, particularly those related to environmental characteristics and product efficacy.
The proposal responds to the growing use of terms such as “eco-friendly” and “biodegradable” in the cosmetics market, often without unified standards or sufficient scientific substantiation. Authorities have raised concerns that inconsistent terminology and exaggerated claims may mislead consumers, highlighting the need for clearer regulatory safeguards.


Key Proposed Amendments
1. New Article 13-2 (Effective Six Months After Promulgation)
The Minister of Food and Drug Safety (MFDS) will be empowered to:
» Develop and promote recommended labelling items and standard terminology
» Provide guidance to prevent consumer misunderstanding
» Improve clarity and consistency in cosmetics advertising


2. New Provision Following Article 14-1 (Effective Two Years After Promulgation)
Where labelling or advertising claims relate to environmental attributes or efficacy — including biodegradability or environmental impact throughout the product lifecycle — companies must demonstrate compliance with:
» Standards set by relevant international organisations (e.g., ISO)
» Requirements established under the Prime Minister’s orders
